Immigration Law at Palacios Law Group

Federal immigration law is the determining factor in whether a person is considered an alien, and will provide the means to whether certain aliens can become naturalized citizens with full rights of citizenship. Immigration law will also determine whether a person can enter or not, and how long they stay and when they have to leave.

The Immigration and Nationality Act, or INA, is the main legislation that governs immigration. It has been amended many times, with one of the most significant times being in 1965 when they established a new quota system. When referring to the INA, an “alien” is defined as a person who is not a citizen of the United States. There are different categories of alien, including resident and nonresident, immigrant and nonimmigrant, and documented and undocumented. While the INA provides the main infrastructure to which immigration policy follows, there are numerous government agencies that declare and implement the statute.

  • To escape persecution: this can include race, religion, nationality, political viewpoint, or even being a member of a certain social or political group
  • To escape conflict or violence: there are many violent areas in countries that these immigrants are coming from, and most are trying to seek asylum in the U.S.
  • To find refuge: this can be from violence, but also from devastating weather events and other environmental factors
  • To seek better healthcare: most need better access to quality healthcare
  • To escape poverty: poverty is a huge problem in many of these countries immigrants are coming from
  • To protect their children: many families want to protect their children from violence happening in their country
  • To get a better education: many want to experience the better educational opportunities that the U.S. has to offer
  • For job opportunities: many immigrants are looking for better work and employment opportunities in the U.S.
